These are the Terms and Conditions on which L’atelier DesLandes Pty Ltd ACN 666 144 056 trading as Twice Upon A Time Bags ("we", "us" or ”our” ) offer our products. By using this website, you agree to be bound to the Terms and Conditions relating to using our website. By clicking “I accept the terms and conditions” when buying a product, you acknowledge our full Terms and Conditions and agree to be bound by them.

By using this site, you confirm that you are over the age of 18 years. Should we suffer any damage or loss as a result of a transaction entered into by a minor, we reserve the right to seek compensation for such losses from his/her parents or guardians.

Authenticity Guarantee

We sell guaranteed authentic luxury vintage and pre-loved items. We provide an Authenticity Certificate on all handbags purchased at no additional cost via a third-party authentication service called Entrupy, a globally recognised authentication solution using artificial intelligence and microscopic computer vision to confirm the authenticity of high value designer items. Entrupy uses state-of-the-art, scientifically proven software combined with expert authenticators to independently review and verify each item. They assess stitching, certificates, hardware, materials, serial numbers and codes, quality and other unique identifiers. Any disputes relating to the authenticity of any item sold via our website should be directed to Entrupy. Where brands or designer items are not supported by Entrupy, we utilise Luxury Authentications Australia to authenticate our items.

Quality of Goods Sold

By purchasing goods from us, you understand that you are purchasing a vintage and/or pre-loved item. This means that our items have been previously owned by someone else, are in most cases used, and could be up to 50 years old. 

You understand that stains, fading, visible scratching on hardware, and wear and tear will be present on items we sell, and given their age, may deteriorate more quickly than items that are brand new. 

We take all these factors into account when pricing and advertising our products, and unless an item is materially and substantially not as described, we do not offer refunds for change of mind on any purchases (subject to our obligations under the Australian Consumer Law).

Please refer to the detailed description and photographs provided in respect of any goods you may wish to purchase and consider whether a vintage or pre-loved purchase is right for you. Manage your own expectations and refrain from purchasing an item from us if you are seeking a brand-new condition item as we only sell vintage or pre-loved goods, and you should be aware that the items will have visible signs of wear. 

We grade the quality of our items as follows:

• Pristine: Mint condition, like new. 
• Excellent: Very good lightly used condition, minimal flaws. 
• Good: Visible flaws and signs of wear. 
• Fair: Obvious signs of wear, very visible flaws.

While we have made every attempt to show textures, appearances and colours of our items as accurately as possible, product images may vary from the delivered product depending on your monitor, settings and computer equipment.  We are not responsible for any such variations in respect of your order.  However, if an item is materially different from the representation on the Website, you may be entitled to a refund or exchange under the Australian Consumer Law.

Unless otherwise stated, any additional items and accessories styled or shown in a product image are for display purposes only and are not included in the listed price. You must ensure that you carefully read the product title and description before purchasing anything from our website.

Orders

We will not commence processing any order made through this site unless and until:

• payment for the order has been received by us in full; and
• the order has passed our internal validation procedures, which are undertaken in order to verify the bona fides of each order for the purpose of preventing credit card and other fraud.

We reserve the right at our discretion to:

• at any time prior to your order being accepted in accordance with these Website Terms of Use, cancel all or part of your order; and
• at any time:
• refuse to provide products to you;
• terminate your access to this site; and/or
• remove or edit any content on this site.

Prices

We reserve the right to adjust the prices for products displayed in this site at any time before you place an order. All prices are in Australian Dollars (AUD) and are inclusive of GST.

You agree that you are liable for, and will pay for, any taxes, duties, customs or import charges that may apply to your order.

Any reference to base pricing on our website is subject to availability. You acknowledge that this is an indication of the pricing only, and we are not obliged to offer any product to you at this base price.

Shipping costs and times

We offerfree same-day delivery to Brisbane Metropolitan customers.

Domestic (within Australia) regular shipping is $15 AUD on all purchases.

International shipping is a $25AUD flat rate.

Order placed before 12pm AEST are shipped on the same day, and orders placed after 12pm AEST are shipped the next business day.

You will receive tracking from our courier service or Australia Post.

Express shipping

If you reside in Brisbane Metro (Australia) you can receive complimentary same day delivery of your purchase if your order is processed by 2pm AEST. If you require your items quickly and you reside in South East Queensland but outside the Brisbane Metro area, we may be able to offer same day delivery for a small fee, depending on your destination. Insurance

Risk and title to any items purchased passes to you once we receive payment in full and the item is shipped. For this reason, we recommend that you purchase insurance at the time of purchasing the item.

Payment

Payment for orders placed through this site may be made by one of the methods displayed at checkout (including Visa, Mastercard, Apple Pay, PayPal, AfterPay and ZIP Money).

Surcharges or fees payable on the various payment options are payable by you and will be calculated at checkout.

By using your selected method of payment, you agree to be bound by the terms of use of that payment platform.

While our payment processing and website hosting providers employ secure technology for transactions with our customers, we will not be responsible for any damages, including consequential losses (whether direct or indirect), that may be suffered by a customer whose credit or debit card, or bank account information is used in a fraudulent or unauthorised manner by any person other than us.

We may request further information from you, such as a copy of your credit card and/or other identification documentation, as part of our internal validation procedures. These procedures help protect bank and credit card account holders from online fraud. Until your order has passed our internal fraud prevention checks, your order will remain on pending status. If further information is requested and you do not provide the requested information within such time as we consider appropriate at its discretion, your order will be cancelled and, if your payment has been received, it will be refunded back to you

To the maximum extent permitted by law, us and our officers, employees, agents, consultants, licensors, partners and affiliates expressly disclaim all conditions, representations and warranties (whether express or implied, statutory or otherwise) in relation to this site and any products purchased or obtained through this site or our social media platforms, including any implied warranty/guarantee of merchantability, fitness for a particular purpose or non-infringement.

This site is provided strictly on an "as is" basis. To the maximum extent permitted by law, us and our officers, employees, agents, consultants, licensors, partners and affiliates make no representation, warranty or guarantee as to the reliability, timeliness, quality, suitability, truth, availability, accuracy or completeness of this site or any of its content, and in particular do not represent, warrant or guarantee that:

• the use of this site will be secure, timely, uninterrupted or error-free or operate in combination with any other hardware, software, system or data;
• this site will meet your requirements or expectations;

• the quality of any products, information or other material purchased or obtained through this site will meet any particular requirements or expectations;
• errors or defects will be corrected; or

Exclusion of liability

To the maximum extent permitted by law, us and our officers, employees, agents, consultants, licensors, partners and affiliates exclude all liability to you or any other person for any loss, cost, expense, claim or damage (whether arising in contract, negligence, tort, equity, statute or otherwise, and for any loss, whether it be consequential, indirect, incidental, special, punitive, exemplary or otherwise, including any loss of profits, loss or corruption of data or loss of goodwill) arising directly or indirectly out of, or in connection with, these Website Terms of Use or the use of this site by you or any other person.

Remedies limited

To the maximum extent permitted by law, us and our officers, employees, agents, consultants, licensors, partners, and affiliates expressly limit their liability for breach of any non-excludable condition or warranty/guarantee implied by virtue of any legislation to the following remedies (the choice of which is to be at our sole discretion):

• the replacement of the goods or the supply of equivalent goods;
• the repair of the goods;
• the payment of the cost of replacing the goods or of acquiring equivalent goods; or
• the payment of the cost of having the goods repaired

To the extent our liability cannot be excluded, our maximum liability to you will be limited to $250 where permissible at law. These Terms and Conditions do not exclude any rights or remedies in respect of goods or services under the Australian Consumer Law which cannot be excluded, restricted or modified.

Without limiting any other remedies available to us at law or in equity, we reserve the right to, without notice:

• temporarily or indefinitely suspend, or terminate, your access to this site or refuse to provide products to you if:
  • You breach any provision of these Website Terms of Use;
  • We are unable to verify or authenticate any information that you provide to us; or
  • We believe that your actions may cause damage and/or legal liability to us, any of our customers or suppliers or any other person; and
  • remove or block access to any information and/or materials (in whole or in part) that we, in our sole and absolute discretion, regards in any way to be objectionable or in violation of any applicable law, any person's intellectual property rights or these Website Terms of Use.

Indemnity

You indemnify and hold harmless us and our officers, employees, agents, consultants, licensors, partners and affiliates from and against any losses, liabilities, costs, expenses or damages (including actual, special, indirect and consequential losses or damages of every kind and nature, including all legal fees on a solicitor-client basis) suffered or incurred by any of them due to, arising out of, or in any way related to (directly or indirectly):

We reserve the right to make any parts of this site accessible only to users who have registered.

We will not be liable for any loss or damage arising from or in connection with your failure to comply with this security obligation. Our items are to be purchased for personal use only and may not be copied, re-sold or rented out without our written permission. Any violation of the above may result in legal action.

We advise we are not affiliated, associated, authorised, endorsed by, or in any way officially connected with the brands we illustrate, and those listed on our site. Unless otherwise stated, all names, marks, emblems and images are registered trademarks of their respective owners.

Copyright claims

If you believe that our site contains any material that infringes upon any copyright that you hold or control, or that users are directed through a link on this site to a third-party website that you believe is infringing upon any copyright that you hold or control, you may send a notification of such alleged infringement to us in writing. Negative Comments

Each Party shall refrain from making negative comments about the other Party, whether online or in person.

No waiver

Waiver of any power or right under these Website Terms of Use must be in writing signed by the party entitled to the benefit of that power or right and is effective only to the extent set out in that written waiver. Any failure by us to act with respect to a breach by you or others does not waive our right to act with respect to that breach or any subsequent or similar breaches.

Severability

The provisions of these Website Terms of Use are severable and, if any provision of these Website Terms of Use is held to be illegal, invalid or unenforceable under present or future law, such provision may be removed, and the remaining provisions shall be enforced.

We reserve the right to amend these Website Terms of Use and any other policy on this site at any time in its sole discretion and any such changes will, unless otherwise noted, be effective immediately. Your continued usage of this site will mean you accept those amendments. We reserve the right, without notice and at our sole discretion, to change, suspend, discontinue or impose limits on any aspect or content of this site or the products offered through this site.

Governing law and jurisdiction

These Terms and Conditions will be governed in all respects by the laws of Queensland. The parties irrevocably submit to the non-exclusive jurisdiction of the courts of Queensland and the courts of appeal from them.
